Minimum Claim Size - FAQ

Frequently asked Questions on the new minimum claim:

1. What is the new minimum claim size?

The minimum claim size in England will be 1ha. This applies to the total area you use to claim payment under the Single Payment Scheme, Area Payment for Nuts and Protein Crop Premium.


2. When does this apply?

From the 2010 scheme year.


3. I claim special entitlements, what minimum claim size will apply to me?

If you hold special entitlements, the minimum claim size will be €200.


4. Will I still receive an SPS application if I am below the 1ha/€200 minimum?
You will still receive a pre-populated claim form for 2010. This is because you have the option to buy entitlements and/or land to bring your claim above the minimum claim size.


5. Can I still claim on agri-environment schemes?

This minimum claim size only affects SPS, Area Payment for Nuts and Protein Crop Premium. It does not change the eligibility requirements for agri-environment schemes.


6. I will be below the minimum claim size in 2010, what will happen to my entitlements?

You will keep your entitlements. However, if you do not use them to claim SPS for 2 years they will be lost to the National Reserve. To avoid this happening you may choose to buy/lease additional land and/or entitlements to increase your claim or you may choose to sell or lease your entitlements to another farmer.


7. I also farm land in Scotland, Wales or N Ireland, which minimum claim size applies?

If you normally send your application form to RPA (because most of your land is in England) then the 1ha (or €200) minimum claim size will apply. The minimum claim size will apply to your entire claim, inclusive of the Scottish/Welsh/N Irish part. If, however, you normally send your application form to the Agriculture Department in Scotland, Wales or N Ireland (because that is where most of your land is located), then their minimum claim size will apply.
