Recipe Registration Procedures

Introduction
1. This notice is to remind you of the procedures involved when using minimum recipe codes.
Background
2. Following a review of our procedures, and consultation with the Commission and our legal advisors, it was concluded that some aspects of our procedures were not in line with regulatory requirements. As a result, there was a change to export refund procedures owing to the removal of the 'recipe applied for' facility.

3. Notice to Traders 51/03 advised of a contingency measure whereby traders could register an interim recipe based on minimum quantities.
Current Procedures
4. You can register an interim recipe based on the minimum quantities required to make your product. This recipe can be used until you have sufficient production records to accurately establish the composition of your product. Export refund payments will be based on the quantities declared under this recipe and you must ensure that the ingredient usage never falls below the levels registered.

5. Claims paid using these recipes will not be reassessed for payment based on the higher quantities when the interim recipe is replaced at a later date. You are not required to provide a measuring period or the names of records held at the point of registration. However, minimum recipes were always intended as an interim measure to allow time to establish sufficient records.
Revised Procedures
6. Minimum recipes are only to be used for an interim period (this being until such time when you have sufficient production records). This notice is to inform operators that from 1 November 2008 a minimum recipe will only be valid for a maximum of 6 months from the recipe start date. When we issue a code for an interim recipe, an automatic end date of six months from the start date will be applied. This date will not be extended. In order to continue claiming export refunds, it will be your responsibility to ensure that you have sufficient records in place in order to re-register your recipe before the end date.

7. All minimum recipes which are currently 'live' on our system will have a six month end date automatically applied to them. However, for those recipes which have already passed the six month time period, you will be given one month to provide us with an application to re-register or confirm you wish the end date to apply. Any operators affected by this change will be notified and informed of the affected recipes.

8. You are not required to provide a measuring period at the point of registration, however, minimum recipes will be subject to verification so you must be able to fully substantiate your minimum recipe. Recovery action will be taken where it is found that a recipe fails to meet the minimum quantities.
